Tenth Arbitrazh Appellate Court confirms decision in favour of Swatch
In a decision rendered on 7 February 2011, the Russian Tenth Arbitrazh Appellate Court confirmed the position taken by the Court of the Region of Moscow according to which the registrant of swatch.ru was prohibited from using said domain name and ordered to transfer the domain to Swatch Ltd.
Swatch is convinced that the Appellate Court’s decision is entirely correct. Russian legislation allows owners of well known brands to protect their rights also in the Internet. In particular, if a cybersquatter's sole purpose is – as it is usually the case – to retain a certain domain name in order to resell it and, by doing so, to hinder the trademark (and company name) owner to use its protected trademark (and company name) in the Internet, such cybersquatter’s activity qualifies as an abuse of rights. More and more courts in the Russian Federation agree to this point of view.
It is a policy of Swatch not to tolerate cybersquatting of its trademarks and to take legal action against all third parties that infringe Swatch trademarks by using them for domain registrations.

Десятый арбитражный апелляционный суд подтвердил решение в пользу Swatch
В постановлении от 7 февраля 2011 г. российский Десятый арбитражный апелляционный суд подтвердил позицию Арбитражного суда Московской области, который запретил администратору доменного имени «swatch.ru» использовать указанное доменное имя и обязал передать его компании «Swatch AG».
Swatch убеждена, что постановление суда апелляционной инстанции полностью обосновано. Российское законодательство предоставляет обладателям широко известных брендов возможность защищать свои права также и в области Интернет. В частности, когда единственной целью киберсквоттера (как это обычно бывает) является удержание доменного имени для его перепродажи и, таким образом, создание препятствий обладателю соответствующих прав на товарный знак или фирменное наименование в использовании защищенных обозначений в сети Интернет, такая деятельность киберсквоттера должна квалифицироваться как злоупотребление правом. Все больше и больше судов в Российской Федерации разделяют эту точку зрения.
Недопущение киберсквоттинга в отношении собственных товарных знаков и использование в этой связи судебных мер против всех лиц, нарушающих права компаний группы «Swatch» при регистрации и администрировании доменов, является устойчивой политикой Swatch.
