Swatch Group terminates partnership with Tiffany & Co. New York for material breach of contract

Biel / Bienne, September 12, 2011 – Today Swatch Group terminated its cooperation contracts with Tiffany & Co. This action became necessary following Tiffany & Co’s systematic efforts to block and delay development of the business.

Within the framework of the long-term partnership agreement, in spring 2008, Swatch Group founded Tiffany Watch Co. Ltd., which was responsible for the development, production and distribution of «Tiffany & Co.» branded watches. Worldwide sales were handled through points of sale operated by Tiffany & Co., by The Swatch Group Ltd and by independent retailers.

Tiffany Watch Co. Ltd. will be permitted to wind down current business over the course of two years following effective termination of the cooperation contracts.

Swatch Group and Tiffany Watch Co. Ltd. will press claims for damages against Tiffany & Co., New York, in compensation for the loss of planned long-term future business.

Bienne, le 12 septembre 2011 – Swatch Group a mis un terme aujourd’hui à sa collaboration avec Tiffany & Co. New York. Cette décision a été rendue nécessaire par le comportement systématique de Tiffany & Co. visant à empêcher et retarder le développement des affaires.

Dans le cadre d’un contrat de collaboration à long terme, Swatch Group avait fondé au printemps 2008 la société Tiffany Watch Co. Ltd., à laquelle il incombait la responsabilité de développer, produire et distribuer les montres de la marque «Tiffany & Co.». Dans ce cadre, les ventes internationales étaient assurées par un réseau de points de vente exploités par Tiffany & Co.New York, par Swatch Group ainsi que par des détaillants indépendants.

Tiffany Watch Co. Ltd. terminera ses affaires courantes dans un délai de deux années, dès l’entrée en vigueur effective de l’annulation des contrats de collaboration.

Swatch Group et Tiffany Watch Co. Ltd. demanderont des dommages et intérêts à Tiffany & Co., New York, en compensation de la perte sur le chiffre d’affaires prévu à long terme.

Biel, 12. September 2011 – Die Swatch Group hat heute die Zusammenarbeitsverträge mit Tiffany & Co. gekündigt. Dieser Schritt wurde nötig, nachdem Tiffany & Co. die Entwicklung des Geschäfts systematisch blockiert und verzögert hat.

Im Rahmen der langfristigen Zusammenarbeit hat Swatch Group im Frühjahr 2008 die Tiffany Watch Co Ltd. gegründet, welche für Entwicklung, Produktion und Distribution der Uhrenmarke «Tiffany & Co.» zuständig war. Der weltweite Vertrieb erfolgte über die Verkaufspunkte von Tiffany & Co., über solche der Swatch Group und über unabhängige Händler.

Nach erfolgter Kündigung wird die Tiffany Watch Co. Ltd. die Möglichkeit haben, die laufenden Geschäfte während zwei Jahren auslaufen zu lassen.

Swatch Group und Tiffany Watch Co. Ltd. werden Schadenersatzforderungen gegen Tiffany & Co., New York, geltend machen, welche den Verlust des langfristig geplanten Geschäftes ausgleichen sollen.
