Swatch wins domain trial in Russia

In a long lasting legal battle before the Court of the Region of Moscow, Swatch has been able to recover the domain name swatch.ru which was owned by a private person in Russia. The judgment rendered on 13 October 2010 represents a precedent in Russian jurisprudence for the fact that up to now, Russian courts had been very reluctant to grant similar claims.

The Court came to the conclusion that the registrant was hindering Swatch from using its trademark and company name as a domain name and that this was to be considered as an abuse of rights, irrespective of the fact that the registrant was not using the domain himself.

It is a policy of Swatch Group not to tolerate cybersquatting of its trademarks and to take legal action against all third parties that infringe Swatch Group trademarks by using them for domain registrations.

Swatch gagne un procès portant sur un nom de domaine en Russie

Au terme d’un long conflit juridique devant la Cour de la Région de Moscou, Swatch a pu récupérer le nom de domaine swatch.ru, appartenant à une personne privée en Russie. Le jugement rendu le 13 octobre 2010 représente un précédent pour la jurisprudence russe qui a jusqu’ici été très réticente à accorder de telles revendications.

La Cour a conclu que le registrant entravait Swatch dans l’utilisation de sa marque et de sa raison sociale en tant que nom de domaine et que ceci était à considérer comme un abus de droits, indépendamment du fait que le registrant ne faisait lui-même aucune utilisation du domaine.

Swatch Group a pour principe de ne pas tolérer l’accaparement de ses marques et d’entreprendre des actions légales à l’encontre de tous tiers qui empièteraient sur ses marques en les utilisant pour l’enregistrement de noms de domaines (cybersquatting).

Swatch gewinnt Domainnamen-Prozess in Russland

In einem langwierigen Rechtsstreit vor dem Gericht der Region Moskau ist Swatch der Domainname swatch.ru zugesprochen worden. Bisheriger Inhaber der Domain war eine Privatperson in Russland. Das Urteil vom 13. Oktober 2010 stellt einen Präzedenzfall in der russischen Rechtssprechung dar, da russische Gerichte bezüglich derartiger Ansprüche bisher sehr zurückhaltend waren.

Vorliegend kam das Gericht zum Schluss, dass der Domaininhaber Swatch an der Nutzung ihrer Marke und ihres Firmennamens als Domainname gehindert hatte. Dies sei als rechtsmissbräuchlich zu beurteilen, unabhängig davon, dass der Inhaber die Domain selber gar nicht genutzt hatte.

Swatch Group toleriert das Cybersquatting ihrer Marken nicht und unternimmt rechtliche Schritte gegen alle Dritten, welche durch die Registrierung von Domainnamen Marken der Swatch Group verletzen.
