Swatch wins domain trial in Russia
In a long lasting legal battle before the Court of the Region of Moscow, Swatch has been able to recover the domain name swatch.ru which was owned by a private person in Russia. The judgment rendered on 13 October 2010 represents a precedent in Russian jurisprudence for the fact that up to now, Russian courts had been very reluctant to grant similar claims.
The Court came to the conclusion that the registrant was hindering Swatch from using its trademark and company name as a domain name and that this was to be considered as an abuse of rights, irrespective of the fact that the registrant was not using the domain himself.
It is a policy of Swatch Group not to tolerate cybersquatting of its trademarks and to take legal action against all third parties that infringe Swatch Group trademarks by using them for domain registrations.
